Terms of Service

1. Acceptance of Terms

By creating an account or using AI Native (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and ScaleGrowth Digital Solutions Private Limited (CIN U62013MH2026PTC467947), a company incorporated in India ("we," "us," or "Company").

2. The Service

AI Native, available at ainative.in, measures how third-party AI assistants (including ChatGPT, Gemini, Perplexity, Claude, and others) represent your brand across AI-generated answers. The Service provides:

  • A "Share of Answer" score showing how often your brand is mentioned or recommended by AI assistants across relevant queries.
  • Dashboard reports and trend data derived from those measurements.
  • A prioritized action plan based on measurement findings.

The Service reports what third-party AI systems say. We do not operate, control, or have any affiliation with those AI systems. Their outputs are independent of us and change without notice.

3. Accounts and Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. If you create an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Acceptable Use

You agree not to:

  • Use the Service to scrape, probe, or abuse the underlying data infrastructure beyond normal product usage.
  • Submit brand or domain data that infringes the intellectual property rights of a third party or that you are not authorized to monitor.
  • Resell, sublicense, or provide access to the Service to third parties without our prior written consent.
  • Use the Service for any unlawful purpose or in violation of applicable law.
  • Interfere with or disrupt the integrity or performance of the Service.

5. Credits, Pricing and Billing

The Service operates on a prepaid credit model. Key terms:

  • 1 credit = 1 USD. Credits are purchased in advance and consumed when scans or measurements run.
  • India billing: Customers billed in India pay 100 INR per credit plus 18% GST as required under the Goods and Services Tax (India) regime.
  • Rest of world: Billed in USD at the published rate.
  • Credits are prepaid, non-transferable, non-refundable, and have no cash value. See our Refunds and Cancellation Policy.
  • Payments are processed by Razorpay. By purchasing credits you agree to Razorpay's payment terms in addition to these Terms.

6. Third-Party AI Sources and No Guarantee

The Service measures and reports what external AI assistants output in response to queries. You acknowledge and agree that:

  • AI assistant outputs are generated by third parties outside our control and change at any time without notice.
  • We make no guarantee that any brand will be mentioned, recommended, ranked, or cited by any AI assistant at any time.
  • Measurement results are a snapshot in time and do not predict future AI assistant behavior.
  • We are not responsible for any business outcome, revenue impact, or competitive result arising from AI assistant outputs or the absence thereof.
  • The action plans we provide are advisory only and do not guarantee improved AI visibility or any business result.

7. Intellectual Property

All software, design, trademarks, and content comprising the Service are owned by or licensed to ScaleGrowth Digital Solutions Private Limited and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. You retain all rights to any brand or content data you submit to the Service.

8. Your Data

You own the brand data, domain names, and query configurations you submit to the Service. By submitting data, you grant us a limited license to process it solely for the purpose of providing the Service to you. We handle your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ScaleGrowth Digital Solutions Private Limited AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY WHERE SUCH LIMITATION IS PROHIBITED BY LAW.

11. Suspension and Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. You may stop using the Service and request account closure at any time by contacting us at [email protected]. Upon termination, any unused credits are forfeited and are not refundable, as set out in our Refunds and Cancellation Policy.

12. Changes to the Service or Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. We may modify, suspend, or discontinue features of the Service at any time with reasonable notice.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Maharashtra, India.
